Oxygen Stress provides AI-powered agricultural diagnostic tools that assess root-zone oxygen stress in crops. The Service includes:

• Free Diagnostic: An oxygen stress assessment based on user-provided data about their growing environment, producing a risk score and actionable tips.
• Photo Analysis: Optional AI-powered visual analysis of uploaded crop photos to enhance diagnostic accuracy.
• Prescription Audit (Paid): A comprehensive zone-by-zone aeration audit with ROI projections, treatment recommendations, and a downloadable PDF report.
• Expert Consultations (Paid): One-on-one consultations with Dr. Jay Dhungel for personalized advice.

3. User Accounts and Registration

The free diagnostic tool does not require account creation. Paid features may require you to provide accurate, complete, and current information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

4. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws
• Upload malicious content, viruses, or harmful code
• Attempt to gain unauthorized access to the Service or its related systems

5. Diagnostic Disclaimer

The diagnostic assessments provided by the Service are for informational and educational purposes only. They are not a substitute for professional agronomic advice, soil testing, or field inspection by a qualified agricultural consultant.

While our AI models are trained on peer-reviewed agricultural research, results may vary based on the accuracy of user-provided data, local conditions, and other factors beyond our control. We do not guarantee specific outcomes, crop yields, or results from following our recommendations.

You acknowledge that agricultural decisions involve inherent risks and that you use the information provided by the Service at your own discretion and risk.

6. Payments and Subscriptions

6.1 Pricing

Paid features are offered at the prices displayed on our Pricing page at the time of purchase. We reserve the right to change prices at any time, but changes will not affect active subscriptions until renewal.

6.2 Billing

Subscription fees are billed on a recurring monthly basis. Payment is processed through our third-party payment provider. You authorize us to charge your designated payment method for all fees incurred.

6.3 Cancellation

You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial billing periods, except where required by applicable law.

6.4 Refunds

We offer refunds on a case-by-case basis. If you are unsatisfied with the Service, please contact us within 14 days of your purchase at support@oxygenstress.com.

7. Intellectual Property

The Service and its original content (excluding user-provided data), features, and functionality are owned by Oxygen Stress and are protected by international copyright, trademark, and other intellectual property laws.

You retain ownership of all data and images you provide to the Service. By uploading content, you grant us a limited, non-exclusive license to process that content solely for the purpose of providing the Service to you.

8. Limitation of Liability

To the fullest extent permitted by applicable law, Oxygen Stress and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, crops, data, or goodwill, arising from or related to your use of the Service.

Our total liability for any claim arising out of or relating to these Terms or the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

9. Disclaimer of Warranties

The Service is provided on an “as is” and “as available” basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components, or that any defects will be corrected.

These Terms shall be governed by and construed in accordance with the laws of Australia, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Australia.

13. Termination
